Terms and Conditions
These Terms and Conditions ("Terms") govern your use of the A Patient Case iOS application (the "App"), operated by A Patient Case ("we", "us"). By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
1. Eligibility
- You must be at least 18 years old.
- You must be a licensed healthcare professional with a valid National Provider Identifier (NPI) number.
- You must register with an invitation code from an existing verified member.
- You must provide accurate registration information. Registering under another person's name or NPI number is prohibited.
2. Your account
You are responsible for keeping your password confidential and for all activity under your account. Notify us right away if you believe your account has been accessed without permission. We may suspend or terminate accounts that violate these Terms or that we cannot verify.
3. Patient privacy and de-identification
You must de-identify every case before uploading it. Remove all patient-identifying information from videos, images, documents, titles, descriptions, and tags, including but not limited to names, faces, voices, dates, locations, record numbers, and any other identifier covered by applicable law such as the HIPAA Privacy Rule (45 CFR §164.514). Do not upload protected health information (PHI).
- You are solely responsible for complying with HIPAA, state privacy laws, your employer's policies, and your professional obligations when you record, upload, or share a case.
- You must have any consent or authorization required by law before recording or sharing a case.
- The App does not automatically remove identifying information from your content. It asks you to confirm that you have done so before a case is published.
- The App is not offered as a system for storing or transmitting PHI.
4. Your content
You keep ownership of the cases, videos, documents, and other content you upload ("Content"). You grant us a non-exclusive, worldwide, royalty-free license to host, store, transmit, display, and distribute your Content as needed to operate the App according to the visibility settings you choose. This license ends when you delete the Content or your account, except where the Content has already been shared with others or we must retain it by law.
You represent that you have all rights needed to upload your Content and that it does not infringe anyone else's rights.
5. Acceptable use
You agree not to:
- upload content containing patient-identifying information;
- use the App to provide or solicit diagnosis or treatment for a specific patient;
- post content that is unlawful, harassing, defamatory, or otherwise objectionable;
- impersonate any person or misrepresent your credentials;
- screen-record, download, or redistribute other members' cases outside the App without their permission;
- attempt to access accounts, data, or systems you are not authorized to access;
- interfere with the operation or security of the App.
6. Community, reporting, and blocking
Cases shared to the community are visible to all verified members. You can report content or users that violate these Terms and block users you do not want to interact with. We review every report within 24 hours and may remove content, restrict features, or terminate accounts at our discretion.
7. Not medical advice
The App is a platform for education and peer discussion among clinicians. Content posted by members reflects their own views and is not reviewed or endorsed by us. Nothing in the App is a substitute for your independent professional judgment or for consultation appropriate to a specific patient.
8. Termination
You may delete your account at any time from the Profile screen in the App. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the App. Sections 3, 4, 7, 9, 10, and 11 survive termination.
9. Disclaimer of warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure.
10. Limitation of liability
To the fullest extent permitted by law, A Patient Case and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or related to your use of the App. Our total liability for any claim relating to the App will not exceed one hundred U.S. dollars (US$100).
11. Indemnification
You agree to indemnify and hold harmless A Patient Case from any claims, damages, and expenses (including reasonable attorneys' fees) arising from your Content, your violation of these Terms, or your violation of any law or third-party right, including patient privacy laws.
12. Apple
The App is distributed through the Apple App Store. Apple is not a party to these Terms and is not responsible for the App or its content. Your use of the App is also subject to the Apple Media Services Terms and Conditions.
13. Changes to these Terms
We may update these Terms from time to time. We will post the updated version on this page and change the effective date above. Continued use of the App after an update means you accept the revised Terms.
14. Governing law
These Terms are governed by the laws of the United States and the state in which A Patient Case is organized, without regard to conflict-of-law principles.
